Terms and Conditions

In addition to the End User License Agreement, these Terms and Conditions govern your acquisition and use of our software. By accepting this Agreement, either by clicking a box indicating your acceptance or by executing an order form that references this Agreement, you agree to the terms of this Agreement. If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority, or if you do not agree with these terms and conditions, you must not accept this Agreement and may not use the software.

User Conduct

You agree to use the software only for lawful purposes and in accordance with this Agreement. Prohibited uses include violating any applicable national or international law or regulation, exploiting or harming minors, sending unsolicited promotional material, or impersonating our employees or other users.

Order Process

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Data Protection (Datenschutz)

In compliance with the General Data Protection Regulation (GDPR) and the Bundesdatenschutzgesetz (BDSG), we commit to protecting your personal data. You must ensure that you have all necessary consents and notices in place to enable lawful transfer of personal data to the software for the duration and purposes of this Agreement. Read the Privacy Policy for details.

Updates and Maintenance

We may provide updates or maintenance releases of the software. While we aim to ensure the software remains current, we do not guarantee that updates will not affect its use or introduce new faults.

Intellectual Property Rights

All intellectual property rights in the software remain our property. This Agreement grants you no rights to the software other than as necessary for its intended use. Read the trademark policy for more information.

Dispute Resolution

Disputes arising under this Agreement will be resolved in accordance with the arbitration rules of the Deutsche Industrie- und Handelskammer (German Chamber of Commerce and Industry). The arbitration will be conducted in German and the seat of arbitration will be Berlin, Germany, unless otherwise required by mandatory consumer protection laws.

Consumer Rights (Verbraucherrechte)

You have the right to cancel your software license within 14 days of purchase for a full refund, in accordance with EU consumer protection laws. Further, this Agreement shall not limit any more favorable consumer rights provided to you by German law.

Impressum Requirement

In compliance with the German Telemedia Act (TMG), our website includes a legally required "Impressum" with our contact information and company details.

Severability Clause

If any provision of this Agreement is found to be invalid under German law, that provision will be modified to reflect the parties' intention or removed if necessary. The remainder of the Agreement will continue in effect.

Acceptance

Your affirmative act of using the software constitutes your electronic signature to this Agreement and your consent to enter into agreements with us electronically.
